CITY OF SOUTH BEND - COUNCIL MEETING - November 14, 2018

1-2. CALL TO ORDER AND PLEDGE OF ALLEGIANCE

The council meeting was called to order by Mayor Struck at 5:30 pm followed by the Pledge of Allegiance. Members present: Councilor Buchanan, Councilor Williams, Councilor Neve, Councilor Davis, Councilor Little, Sergeant Stigall and Clerk/Treasurer Roberts. Police Chief Eastham and City Supervisor Houk were absent.

3. APPROVAL OF AGENDA, CONSENT AGENDA, AND APPROVAL OF MINUTES

A motion was made by Councilor Neve to approve the Agenda, Consent Agenda and the minutes of the October 22, 2018 regular meeting. The motion was seconded by Councilor Williams.

Vote: Ayes-5, Noes-0, Absent-0

5. PUBLIC HEARING @ 5:31 PM – 2019 FINAL BUDGET

Mayor Struck opened the public hearing at 5:31 pm. Citizen Chris Thompson from 211 S Jackson explained the need to create a reserve fund by asking the department heads to cut a percentage from their budget. There were no additional comments and the public hearing was closed at 5:32 pm.

6. ORDINANCE #1538 – PROPERTY TAX LEVY (SECOND READING)

Councilor Neve made a motion to accept Ordinance #1538 – Property Tax Levy as presented. The motion was seconded by Councilor Williams.

Vote: Ayes-5, Noes-0, Absent-0

7. ORDINANCE #1539 – ADOPTING 2019 BUDGET (FIRST READING)

Councilor Neve made a motion to move Ordinance #1539 – Adopting 2019 Final Budget to a second reading. The motion was seconded by Councilor Williams.

Councilor Buchanan felt that this process was incomplete. There was not time to talk about goals and that there was no public input. He would like to hear people’s ideas and what the other councilors feel or think. Councilor Davis asked when they would discuss ways to raise money. Mayor Struck noted that discussion can be held anytime not just during budget season. Vote: Ayes-4, Noes-1, Absent-0 (Ayes – Councilor Williams, Councilor Neve, Councilor Davis, Councilor Little. Noes – Councilor Buchanan)

8. ORDINANCE #1540 – AMENDING, REPEALING & ADDING TO CHAPTER 8.20 – GARBAGE SERVICE (FIRST READING)

Councilor Neve made a motion to move Ordinance #1540 – Amending, Repealing & Adding to Chapter 8.20 – Garbage Service to a second reading. The motion was seconded by Councilor Davis.

Clerk/Treasurer Roberts gave a brief overview of the ordinance, explaining that this ordinance will go into effect when LeMays takes over the city’s garbage service. Generally it doesn’t change how garbage service is handled in the city, it just addresses garbage service from a third party standpoint.

11. MAYOR’S REPORT
  • Mayor Struck read from Chapter 5 – Audience Participation/Addressing the Council, Section #5.3, 5.4 and 5.5 of the South Bend City Council Rules & Procedures Manual.
  • Mayor Struck reported that K D & S Environmental has completed their assessment of the South Bend Library and the abatement costs will be a bit under $17,000. The Friends of the Library will be paying for the abatement. They will work directly with K D & S Environmental.
12. COUNCIL COMMENTS
  • Councilor Buchanan pointed out that during the budget process he was never critical of any department. He thinks they are doing a good job.
  • Councilor Williams was happy with the news on the library!
  • Councilor Neve agreed – great news for the library!
  • Councilor Davis also agreed about the library.
13. EXECUTIVE SESSION – LABOR NEGOTIATIONS

Prior to adjourning to Executive Session Mayor Struck advised that there was a possibility that a decision would be made. Mayor Struck called the Executive Session to order at 5:46 PM for 15 minutes for the purpose of labor negotiations. Councilor Buchanan, Councilor Williams, Councilor Neve, Councilor Davis, Councilor Little, Sergeant Stigall and Clerk/Treasurer Roberts were present.

Mayor Struck reconvened the meeting at 5:58 pm.

Councilor Little made a motion to accept the Teamster Union Local #252 Contract as presented. The motion was seconded by Councilor Neve.

For the purpose of transparency Mayor Struck provided those in attendance the following information about the union contract – It is a two year contract, in 2019 the employees will receive a 3.1% wage increase, an additional $5.00 per month Longevity and an additional $50.00 per month towards their health insurance. In 2020 the employees will receive a 3.0% wage increase and an additional $50.00 per month towards their health insurance.

14. ADJOURNMENT

The meeting was adjourned at 5:59 PM to meet again on Monday, November 26, 2018 for the next regularly scheduled meeting at South Bend City Hall
